For the purpose of these terms & conditions the following words shall have the following meanings:
(a) “The Company”, “our” shall mean Selkent Electrical Limited.
(b) “The Customer” shall mean the person or organisation for whom the Company agrees to carry out works &/or supply materials. The Operative or Engineer shall mean he representative appointed by the Company.
These terms & conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative of the Company & by the Customer. Further, these terms & conditions shall prevail over any terms & conditions used by the Customer or contained or set out or referred to in any documentation sent by the Customer to the Company; by entering into a contact with the Company the Customer agrees irrevocably to waive the application of any such terms & conditions.
a. All electrical installation work will comply with BS7671:2018 and any amendments in force at the time of the works.
b. Where work is to extend or modify existing circuits, including consumer unit upgrades, cost estimates assume that the existing installation is in adequate condition and complies with minimum current regulations. Any works found required to bring the necessary parts of the existing installation up to standard will be at additional cost of our hourly rate per hour incurred + any materials used.
c. Unless stated otherwise, all cables will be concealed by chasing into the building fabric or concealed in building voids, under floors, etc. Where impracticable, cabling will be neatly surface run, either clipping direct or housed in trunking / conduit.
d. Where carpet or flooring coverings may require lifting to allow concealed installation work, no charge is made for this service, with our “best endeavours” being made to avoid damaging them and to refit them to an acceptable standard.
However, consideration of employing a specialist fitter may be prudent, at your cost to effect a fully satisfactory reinstatement.
e. Our “best endeavours” will be made to undertake installation work to a clean standard, using dust sheets and vacuum cleaning equipment as necessary, all items within the vicinity of our working area are to be removed by client prior to commencement of works, where impractical, items should be fully covered by client for the duration of the works.
f. Any damages or defects are to be declared to the engineer before leaving site, after this time no responsibility will be assumed on our part for any damages reported.
g. Material Collection:
Collection of non-stock items is chargeable but;
(a) Time must be kept to a minimum & reasonable.
(b) If the collection time is likely to exceed 45 minutes the customer must be additionally informed of the circumstances.
h. If the Customer cancels their instructions prior to any work being carried out or materials supplied then the Customer shall be liable for any related expenditure together with the profit that would have been made by the Company had the work been carried out &/or materials supplied in accordance with such instructions.
a. Clearing and / or moving of furniture and other items blocking access to work areas are not included.
b. Except where detailed, builders work (creating of holes larger than 50mm diameter,
creating of support structures, etc).
c. Re-decoration and “making good” of any holes or access points created related to our
work.
a. All extras and variations must be agreed in writing prior to commencement.
a. Any estimate given assumes continuous and unhindered access to the site by prior arrangement with you.
b. Unless stated otherwise, the estimate given assumes standard working hours between the hours of 08:00 hrs - 17:00 hrs Monday to Friday inclusive. Work required outside these hours may attract out of hours premium rates.
c. All figures quoted are valid for a date of 7 days from the date of the estimate or quotation.
d. All parts supplied as part of an installation will be charged at our cost +handling fees.
e. Where customer supplies materials for an installation or part thereof, any delays to the
installation or incompatibility issues will incur further charges.
a. All work where applicable, will be executed fully in compliance with applicable Building Regulations and BS7671 in force at the time of the work, particularly in respect of work in dwellings to allow the legal Part P obligations to be met. Where a Client requires deviation from such regulations, a written instruction and record will be required.
a. Title to any goods, supplied by the Company to the Customer shall not pass to the Customer but shall be retained by the Company until payment in full for such goods has been made by the Customer to the Company. Until such time as title in the such goods has passed to the Customer:
(i) the Company shall have absolute authority to repossess, sell or otherwise deal with or dispose of all any or part of such goods in which title remains vested in the Company,
(ii) for the purpose specified in (i) above, the Company or any of its agents or authorised representatives shall be entitled at any time & without notice to enter any premises in which goods or any part thereof is installed, stored or kept, or is reasonably believed so to
be.
(iii) the Company shall be entitled to seek a court injunction to prevent the Customer from selling, transferred or otherwise disposing of such goods.
Notwithstanding the foregoing, risk in such goods shall pass on delivery of the same to the Customer, & until such time as title in such goods has passed to the Customer, the Customer shall insure such goods to their replacement value & the Customer shall forthwith, upon request, provide the Company with a certificate or other evidence of such
Insurance.
a. Selkent Electrical Ltd warrants its installation work to be defect free for a period of 72 months from invoice date. Such cover does not extend to goods not supplied by Selkent Electrical Ltd, works carried out on old systems, emergnecy repair works, physical damage to products or any instance where the original installation has been altered or
tampered with subsequently by third parties.
b. If, after the Company shall have carried out the works, the Customer is not wholly satisfied with the works then the Customer shall give notice in writing within 12 months to the Company & shall afford the Company, and its insurers, the opportunity of both inspecting such works, & carrying out any necessary remedial works if appropriate. The Customer accepts that if he fails to notify the Company as aforesaid then the Company shall not be liable in respect of any defects in the works carried out.
c. The company will not guarantee any work undertaken on instruction from the customer & against the written or verbal advice of the operative/engineer. Work is guaranteed only in respect of work directly undertaken by the company & payment in full has been made. Any non-related faults arising from recommended work which has not been undertaken by the company will not be guaranteed. The company shall not be held liable or responsible for any damage or defect resulting from work not fully guaranteed or where recommended work has not been carried out. Work will not carry a guarantee where the customer has been notified by the operative either verbally or indicated in ticked boxes or in Comments/ Recommendations of any other related work which requires attention. The customer shall be solely liable for any hazardous situation in respect of Electrical Regulations or an electrical danger Notice issued.
d. Where the Company agrees to carry out works on installations of inferior quality or over ten years old at that date no warranty is given in respect of such works & the Company accepts no liability in respect of the effectiveness of such works or otherwise.
e. The Company shall only be liable for rectifying works completed by the Company & shall not be held responsible for ensuing damage or claims resulting from this or other work overlooked or subsequently requested & not undertaken at that time.
a. Unless agreed in writing payment in full must be made at the specified intervals of the chargeable works carried out to Selkent Electrical Ltd via Cash or Bank Transfer.
b. Payment Schedule for installation works:
50% of total prior to commencement of works,
35% of total upon completion of first fix works (including any extra works or variations) or at pre agreed interval.
Remaining outstanding balance including any additional works due upon completion of works carried out.
c. Payment schedule for electrical testing works:
Total quoted balance will be payable in advance for all electrical testing works.
d. On some Contracts staged payments are to be made at pre arranged interval throughout
e. Invoices are due for payment immediately upon delivery to the Customer. Any part of that invoice which remains unpaid shall carry interest at the rate of 4% over the base rate until payment in full is received by the Company.
f. All certification will be supplied after full and final payment has been received by Selkent Electrical Ltd.
• These terms & conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative of the Company & by the Customer. Further, these terms & conditions shall prevail over any terms & conditions used by the Customer or contained or set out or referred to in any documentation sent by the Customer to the Company; by entering into a contact with the Company the Customer agrees irrevocably to waive the application of any such terms & conditions.
• These terms & conditions & all contacts awarded between the Company & Customer shall be governed & construed in accordance with English law & shall be subject to the exclusive jurisdiction of the English law.
Notice of right to cancel.
• You are entitled to a 14 day cooling off period commencing from the date of acceptance.
You have a right to cancel the contract within this period (not if works have commenced however) and this right can be exercised by notifying us via electronic mail to our email address.
If however, work has commenced and you decide to terminate the contract then we reserve
the right to charge any/all of the following:
• a cancellation fee
• labour costs up until the time you cancelled
• any items installed or fitted that can’t be removed without damaging them
• the return of any items that have been delivered but not installed (or can be easily
uninstalled)
• any loss of profit caused by your cancellation (eg where time has been set aside to do your work and can’t book another job for the same period).
If you request cancellation at a later date, then unless we are in breach of contract we have the right to refuse or retain all or part of you deposit.
